1. Parties and Activities

This agreement is between the participant identified below (“Participant”) and AQBJJ, LLC, doing business as AQBJJ Minha Familia (“AQBJJ”), located at 5301 N. Birch St., Suite E2, Pharr, Texas 78577. If Participant is under 18, “I” and “me” also refer to the signing parent or legal guardian where applicable.

“Activities” include Brazilian Jiu-Jitsu, grappling, rolling, wrestling, kickboxing, striking, mixed-martial-arts training, self-defense training, strength and conditioning, fitness activities, open mats, private or group instruction, seminars, camps, competitions, demonstrations, events, use of AQBJJ premises and equipment, and travel or participation connected with AQBJJ-sponsored activities. “Activities” also include Zilla Gunworks 2A Proficiency and Education conducted only in an instructor-controlled, sterile, laser-only environment using inert or laser-emitting training pistols, holsters, targets, and non-projectile training aids. No live firearm, live ammunition, blank ammunition, or projectile-firing device is permitted or covered. Any live-fire range training requires a separate waiver, venue rules, and instructor authorization.

2. Acknowledgment and Assumption of Risk

I understand that the Activities are physically demanding contact activities with inherent and other risks that cannot be eliminated without changing their essential nature. Risks include, without limitation:

• falls, throws, takedowns, sweeps, collisions, striking, sparring, rolling, joint locks, chokes and compression;
• strains, sprains, cuts, bruises, dislocations, fractures, dental or eye injury, skin infection, concussion, traumatic brain injury, neck or spinal injury, paralysis, cardiac events, illness, permanent disability, and death;
• acts or omissions of other participants; differences in size, strength, age, skill, experience, or temperament; and imperfect matching or supervision;
• mat, floor, premises, equipment, weather, heat, humidity, sanitation, and emergency-response risks; and
• risks that are known or unknown, foreseeable or unforeseeable.

I knowingly and voluntarily accept and assume all risks of participating in the Activities, including the risk of serious injury or death.

3. Sterile Laser-Only 2A Proficiency and Education

I understand that this portion of the Activities is education and dry-fire/laser simulation only. The training area is a sterile environment. Live firearms, live ammunition, blank ammunition, and devices capable of firing a projectile are prohibited. Only instructor-approved inert or laser-emitting training devices may be handled. If a live firearm, ammunition, or other prohibited item is discovered, training must stop immediately and the instructor must be notified.

Photosensitivity and visual-effects notice: AQBJJ does not use flashing, strobing, simulated muzzle-flash, or rapidly flickering technology during this training. The program uses instructor-approved laser training pistols that emit a visible laser and compatible targets. Even without strobing effects, a participant with epilepsy, a seizure history, photosensitivity, visually triggered migraines, fainting, or a related concern should notify the instructor before training if a safety accommodation is needed and may decline a drill or request a reasonable alternative. I will stop immediately and notify the instructor if I experience an aura, dizziness, unusual visual effects, nausea, confusion, involuntary movement, loss of awareness, or another concerning symptom.

Laser-eye safety: I will never stare into a laser beam or intentionally direct a laser at or near any person’s eyes or face. I will not aim at mirrors or other reflective surfaces and will use laser training devices only as directed by the instructor.

I agree to follow the four universal firearm-safety rules throughout training, including when handling an inert or laser device:

1. Treat every firearm or training device as if it is loaded.
2. Never point a firearm or training device at anything I am not willing to destroy.
3. Keep my finger off the trigger until my sights are on target and I have made the decision to fire.
4. Be sure of my target and what is in front of and beyond it.

I will follow all instructor commands; keep training devices holstered or staged as directed; never direct a laser into another person’s eyes; and immediately report unsafe conduct, damaged equipment, or any possible breach of the sterile environment.

Even without live ammunition, dry-fire and laser training—including drawing, holstering, movement, positional work, scenario drills, and controlled self-defense drills with inert or laser devices—can involve trips, falls, collisions, strains, pinches, impact injuries, repetitive-motion injuries, unintended laser exposure, equipment malfunction, and unsafe acts by participants. I knowingly and voluntarily accept these risks.

4. Health, Safety, and Conduct

I represent that I am physically and mentally able to participate safely, or that I have consulted an appropriate health-care professional when needed. AQBJJ has not provided medical advice or guaranteed that participation is safe for me. I will disclose to staff any limitation that materially affects safe participation, stop if I feel unsafe or unwell, obey academy rules and coaching instructions, tap promptly, and refrain from participating while impaired by alcohol or drugs or while I have a contagious condition that may endanger others.

I understand that AQBJJ does not provide health or accident insurance for me and that I am responsible for my own medical expenses.

5. Release of Liability — Including Ordinary Negligence

This release expressly includes, without limitation, alleged ordinary negligence in instruction, coaching, supervision, participant matching, failure to warn, premises or equipment inspection or maintenance, sanitation, first aid, emergency response, or enforcement of rules. This agreement does not release gross negligence, reckless conduct, or intentional misconduct to the extent such claims cannot lawfully be released.

6. Covenant Not to Sue and Limited Indemnity

I agree not to sue a Released Party for a claim released by this agreement. I will indemnify and hold the Released Parties harmless from third-party claims caused by my intentional or reckless conduct, my material violation of academy rules, or my material misrepresentation in this agreement. This limited indemnity does not require me to indemnify a Released Party for that party’s own gross negligence, reckless conduct, or intentional misconduct.

7. Emergency Medical Authorization

If I am injured or become ill and cannot provide instructions, I authorize AQBJJ personnel to provide or arrange reasonable first aid, CPR/AED use, emergency medical services, and transportation. I understand that AQBJJ cannot guarantee the availability or outcome of care. I am responsible for resulting medical and transportation charges.

8. Personal Property

I am responsible for my personal property. AQBJJ is not responsible for loss, theft, or damage except to the extent caused by conduct that cannot lawfully be released.

9. Parent or Legal Guardian Terms for a Minor

If Participant is under 18, I represent that I am Participant’s parent or legal guardian and have authority to sign. I consent to the minor’s participation and emergency care. I release my own claims arising from the minor’s participation and, to the fullest extent permitted by Texas law, agree to the assumption-of-risk and release terms on behalf of the minor. I understand that Texas law may limit the effect of a parent’s pre-injury release of a minor’s claims and that this section should be reviewed by Texas counsel.

10. Electronic Records and Signature

I consent to conducting this transaction electronically. I intend my typed signature and submitted form to be my electronic signature, with the same effect as a handwritten signature. I may save or print this page before submitting and may request a copy from AQBJJ. The submission date, time, agreement version, and available technical audit information may be retained with the record.

11. Governing Law, Venue, Severability, and Duration

Texas law governs this agreement. Exclusive venue for a dispute shall lie in a court of competent jurisdiction in Hidalgo County, Texas. If any provision is unenforceable, it shall be narrowed or severed and the remaining provisions shall continue in effect. This agreement contains the complete agreement concerning the subjects addressed here and may be modified only in a writing signed by AQBJJ and me.

This agreement applies to participation for one year from the date signed. Revocation or expiration does not affect Activities occurring before revocation or expiration.

12. Required Audio, Video, Photograph, Surveillance, and Media Consent

I understand and acknowledge that AQBJJ premises use continuous, 24/7 audio and video security monitoring in posted areas for safety, security, incident review, training documentation, and operational purposes. I consent, for myself and, if applicable, my minor child, to being photographed, filmed, audio-recorded, and otherwise recorded while on the premises or participating in the Activities.

I authorize AQBJJ, Zilla Gunworks, and their assigns and licensees to use, reproduce, edit, publish, distribute, display, and create derivative works from my—or my minor child’s—name, image, likeness, voice, photograph, video, and other recordings in any media for security, educational, documentary, website, social-media, advertising, publicity, and promotional purposes without compensation. I waive any right to inspect or approve finished materials and release claims arising from authorized use except claims that cannot lawfully be waived. I understand this consent is a condition of participation and remains effective for recordings made during the term of this agreement. Any written revocation applies only prospectively to future participation and recording and does not require AQBJJ to recall or remove material already created, published, distributed, or committed for publication.

Participant and Signature Information

All required acknowledgments must be completed. For a minor, the parent or legal guardian—not the child—must submit the electronic signature.
